Mr. Van Zandt represents financial institutions faced with consumer class and individual actions and origination matters involving claimed Truth in Lending Act (TILA) and Real Estate Settlement Procedure Act (RESPA) violations. Mr. Van Zandt also handles matters involving loan servicing with claimed violations of the Fair Credit Reporting Act (FCRA) and California and Federal Fair Debt Collections Practices Act (FDCPA). He also defends claims of wrongful foreclosure, particularly those involving consumers attempting unmeritorious foreclosure avoidance.
Mr. Van Zandt is also retained by leading insurance carriers to defend policy holders in a wide range of cases including catastrophic injury claims and major property damage claims requiring aggressive defense of target defendants.
He has tried nearly 30 cases to verdict and has handled hundreds of arbitrations and mediations.
A partner since 2003, Mr. Van Zandt is a 1985 graduate of Pitzer College in Claremont where he received a Bachelor of Arts degree in Political Studies with a minor in Sociology. He earned his Juris Doctorate degree in 1990 from San Francisco Law School . Mr. Van Zandt was formerly a partner with Clapp, Moroney, Bellagamba & Vucinich and was Special Counsel with Severson & Werson.
Mr. Van Zandt is admitted to all California State and Federal District Courts as well as the U.S. Court of Appeals for the Ninth Circuit. He has been admitted Pro Hac Vice in more than 12 other jurisdictions and regularly speaks on topical issues at legal education conferences. He is a member of the Bar Association of San Francisco, The Lawyers Club, the ABA Litigation Section, American Inns of Court, and serves as a Judge Pro Tem for the Santa Clara County Superior Court.
